A panel of judges appointed by Democratic presidents has temporarily paused a gag order in former President Donald Trump’s trial for his alleged interference in the 2020 election.

The order prohibited Trump from making public comments about the special counsel and witnesses in the upcoming trial.

Trump’s legal team had appealed the gag order, arguing that it violated his right to political speech.

The appeals court decision does not indicate its opinion on the gag order itself, but rather has given the court more time to review the case.

“The purpose of this administrative stay is to give the court sufficient opportunity to consider the emergency motion for a stay pending appeal and should not be construed in any way as a ruling on the merits of that motion,” the order stated.

Trump remains under a gag order in a separate civil trial brought against him by the New York Attorney General.
